Overview

In line with the Statutory Framework for the Early Years Foundation Stage (EYFS), there are specific instances when Ofsted must be informed about serious incidents or changes at the setting. This is crucial for maintaining the safety and well-being of children in our care.


When to Inform Ofsted

Providers must inform Ofsted immediately if any of the following occur:

  1. Allegations of Serious Harm or Abuse
    Any allegations of abuse or harm by someone at the setting (whether on or off the premises) must be reported to Ofsted without delay. This includes any action taken in response to these allegations. Failing to report such allegations is a legal offence. 🚨

  2. Changes to Care Facilities
    If there are changes to the care facilities that might affect the space or level of care for the children, this must be reported. πŸšͺ

  3. Serious Accidents or Illnesses
    ​Ofsted must be notified immediately if a child suffers a serious injury, illness, or death while under care. The setting must also act on any advice provided. πŸ₯

  4. Food Poisoning
    If two or more children experience food poisoning while at the setting, Ofsted must be notified. 🍽️

  5. Changes to the Provider or Management
    Any changes to the provider or the person with direct responsibility for early years provision must be reported to Ofsted. This also includes:

    • Employing an assistant for childminding services.

    • Changes to anyone 16 years or older living or working on childminding premises.

    • Proposals to change childcare hours, including overnight care. ⏰

    • Changes to the premises that may affect the quality of childcare. 🏠

    • Change of address, name, or company details.

  6. Criminal Offences
    If the registered provider commits any criminal offence after the time of registration, this must be reported to Ofsted. βš–οΈ

Providers must inform Ofsted about any significant changes or events related to the premises used for childcare, such as:

  • Structural alterations or extensions 🏠

  • Any event that disrupts the operation of the provision for a sustained period πŸ”„

  • Changes to the outside areas, such as adding a pond or removing fences 🏞️

All necessary notifications must be made by calling Ofsted at 0300 123 1231 as soon as possible. πŸ“±

  • The registered person is responsible for ensuring these notifications are made promptly.


Failure to Comply

Failure to report any of the above incidents or changes is considered a serious offence and can lead to legal consequences.
